We understand that being involved in a vehicle accident is already unpleasant enough; dealing with your insurance company shouldn’t make the situation any more stressful. Below we have listed three essential rights you have regarding car insurance and auto repair in the state of California.


Essential Rights

You have the right to choose your own repair shop: If you are in an accident or collision in California, state law dictates that you have the right to take your vehicle to the repair shop of your choice. Insurance companies typically have a list of “preferred” repair shops, but you are not obligated to use one of theirs.


You have the right to have your vehicle repaired to its pre-accident condition: Your insurance company is under obligation to provide you with the sufficient funding to repair your vehicle back to its pre-accident condition.


You have the right to Original Equipment Manufacturer (OEM) parts, or aftermarket parts of equal or greater value: In California, if your auto repairs require part replacement, insurance companies may only require you to use aftermarket parts if they are of equal or greater value to the OEM part in terms of type, quality, safety, and performance. Be sure to compare the proposed aftermarket part with its OEM counterpart.


Any complaints regarding violations of these rules or unfair practices on the part of your insurance company may be directed to the California Department of Insurance.
